What is considered actual knowledge of a violation?

Employers with actual knowledge of a driver violating Subpart B of Part 382 must report it to the Clearinghouse under §382.705(b)(4).
Service agents (such as C/TPAs like Hope Diagnostics) may also report on behalf of employers following the same regulations.
Actual knowledge includes:
Direct observation
Information from previous employers
DUI or traffic violations involving a CMV
Driver admission (except as limited under §382.121)

If a driver has a drug and alcohol program violation in one State, then applies for a commercial driver’s license (CDL) in another State, will the Clearinghouse be able to connect that driver’s drug and alcohol violation history to the new CDL?

Yes. The Clearinghouse links CDLs across states, ensuring that a driver’s drug and alcohol violation history remains complete and accessible, even if they obtain a license in a different state.

Do I need to complete Steps 1–4 before using your service?

Yes. We only handle Steps 5 of the FMCSA Return-to-Duty process. You must complete your SAP evaluation and follow-up treatment (Steps 1–4) before we can begin.

No problem — we maintain a verified list of DOT-approved Substance Abuse Professionals (SAPs) that we have worked with. Visit our SAP List page to find a counselor near you. You must complete Steps 1–4 with a SAP before we can begin your RTD process.

That's okay — don't pay until you've confirmed Steps 1–4 are checked off in the FMCSA Clearinghouse. Our team can also help you verify your status before you start.

Do you handle Step 6?

Yes, we can assist with Step 6 for owner-operators with an active DOT number, in compliance with Federal Motor Carrier Safety Administration regulations. For company drivers, this step is typically handled by their employer.

No. A negative RTD test makes you eligible, but each employer decides whether to hire or reinstate you.

At least 12 months and up to 5 years, with a minimum of six unannounced follow‑up tests in the first year.
